Basic Facts

Plaintiff

A Co., Ltd. (hereinafter “Plaintiff”) is a company that runs wholesale and retail business, such as livestock product processing and meat, and Defendant D Co., Ltd. (former trade name: E Co., Ltd.; hereinafter “Defendant Company”) is a company that has traded livestock products with the Plaintiff Company, and Defendant F is a representative director of the Defendant Company.

Defendant C is an individual entrepreneur who has traded goods with the Plaintiff Company under the trade name of “E,” and Defendant G is a person who was an employee of an educational foundation I operating wholesale and retail business, such as food, under the trade name of “H” (hereinafter “H”).

From January 1, 2016 to February 7, 2017, Defendant C supplied 22,857,443 won from the Plaintiff Company and did not pay the price.

Plaintiff

On May 12, 2016, the Company remitted 128,000,000 won to the Defendant Company to the Defendant Company, and on the same day, the Company prepared a certificate of borrowing set at 128,000,000 won, the due date for repayment, and 6.9% per interest month between the Defendant Company and the Defendant Company. The Defendant F signed the said certificate of borrowing as a joint guarantor.

Plaintiff

Around May 9, 2016 and May 10, 2016, the Company supplied the Defendant Company with Chinese-style land equivalent to KRW 72,937,900.

Plaintiff

On May 12, 2016, the Company issued a transaction statement stating "H, supply price of KRW 1,173,600, the outstanding amount of KRW 72,937,900, the total outstanding amount of KRW 74,111,500, the total outstanding amount of KRW 74,500, and the total outstanding amount of KRW 71,50,00, the Company supplied KRW 16.30km to H. on May 12, 2016." On May 13, 2016, the Company signed a transaction statement stating "H, the supplied good, the Han-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S
