1. 피고인 A, B의 도박개장 피고인 A, B은 이른바 ‘방세’ 및 ‘관리비용’ 명목으로 피고인 A은 15만 원, 피고인 B은 10만 원을 각각 가지고 가기로 약속하고, 피고인 A은 2014. 4. 9. 06:30경부터 같은 날 09:50경까지 자신이 월세를 지불하여 빌린 군포시 G 407호(H)에 화투, 모포, 원탁 등을 준비하여 도박장을 마련하고, 피고인 B은 C, I, J, K, L, M 등에게 전화를 걸어 위 장소로 불러모은 다음, 도박의 진행 및 판돈을 관리하는 이른바 ‘하우스장’을 하면서 C 등에게 ‘고스톱’과 ‘도리짓고땡’ 도박을 하게 하여, 공모하여 영리를 목적으로 도박장을 개설하였다.

2. 피고인 A의 도박개장 피고인 A은 2014. 4. 5. 03:00경부터 같은 날 07:00경까지 제1항 기재와 같은 장소에서, K, C, 일명 ‘N’이라는 여성, 일명 ‘O’라는 남성, P 등이 도리짓고땡과 고스톱 도박을 하게 하고, 방세 명목으로 15만 원을 받아 영리를 목적으로 도박장을 개설하였다.

3.
