A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2017 Highest 1823, hereinafter “1823”), the Defendant, “sports soil,” etc., was absent from gambling, with the need of money for gambling, thereby raising money for goods by deceiving another person.

On February 21, 2017, the Defendant: (a) reported on February 21, 2017, that “the Defendant sold the victim’s contact number by comments on comments made by the seller of the Internet bulletin board (cafe.naver.com / Joint Longgora)” prepared by the seller of the name and non-name of the bulletin board; and (b) contacted the victim with the victim as if the Defendant was a seller, the Defendant would send the goods if he remitted the transaction price.

“The purpose of “ was to make a false statement.”

However, the defendant did not possess the above goods and thus did not have any capacity or intent to sell the goods even if he receives the transaction price from the victim C.

On February 21, 2017, the Defendant, by deceiving the victim C, received KRW 100,00 from the Agricultural Cooperative Account (Account Number: D) in the name of the Defendant, and acquired pecuniary benefits equivalent to the said amount by receiving KRW 8,808,60 in total from January 21, 2017 to March 4, 2017 as stated in the list of crimes (attached Form 1) from 30 victims.

[2] On December 6, 2016, the Defendant: (a) did not possess any goods to sell; (b) did not intend to sell them; and (c) did not intend to sell so; and (c) “Mafe.naver.com.com/joint venturena” on the bulletin board of the Republic of Korea (Cafe.naver. Sgora).

“I will send things first when you send money to the victim E who written a letter and reported and contacted the above writing.”

“Falsely speaking, it received KRW 5,170,00 in total from 10 victims in the same manner as indicated in the crime list, including the remittance of KRW 970,00 from the victims E to the Saemaul Treasury Account (F) in the name of the Defendant, from November 8, 2016 to January 18, 2017.
