Reasons
Punishment of the crime
1. Joint criminal conduct by Defendant A and B;
A. From April 2012 to May 2012, the Defendants operated a mobile phone sales store with the trade name “F” in Bupyeong-gu, Nowon-gu, Seoul and from 2012, and the so-called “TM office” means a place where many unspecified people gather documents related to opening of a mobile phone, such as a copy of the resident registration certificate and a certificate of personal seal impression.
On May 1, 2012, the Defendants purchased necessary documents, such as a copy of the resident registration certificate of G, from the TM office operated by bad persons in the name of the Defendants, and prepared an application for opening of a mobile phone in the name of G, and opened a mobile phone by sending it to the LG U mobile operator.
However, in fact G only opened a mobile phone line to obtain a loan, but actually purchased a mobile phone terminal and did not have the intention or ability to use the mobile phone.
As a result, the Defendants conspired in collusion with employees in charge of the victim LG U’s name and received one cell phone device from the above employees, and received subsidies of KRW 574,00 from H to the account of community credit cooperatives under H’s name, and received subsidies of KRW 574,00 from May 31, 2012 through May 51, 2012, including all of the following facts: (a) the victim LG U received 52 cell phone terminals in total from the victim LG U in the same way through the same method; and (b) received subsidies of KRW 30,859,000 in total from the above community credit cooperatives account.
B. From June 2012 to August 2012, the Defendants jointly committed a crime with I and J operated a mobile phone sales store in the name of “L” in Bupyeong-gu Incheon, Bupyeong-gu, Incheon. The I operated the “O”, which is a mobile phone sales store in Yeonsu-gu, Incheon, as the head of LG U distribution 4 business division, and the J operated the “O” as an employee of the said “O”.
