1. The defendant's appeal and the plaintiff's incidental appeal are all dismissed.

1. Determination on the claim for transportation expenses

A. On February 7, 2013, the Plaintiff engaged in waste collection and transportation business under the name of B, the Plaintiff entered into a contract with the Defendant on the collection and transportation of food wastes. Article 2 (Settlement Method and Disposal Expenses) of the same Act is classified as follows; Article 2 (Payment Method and Disposal Expenses) of the same Act shall submit the records of disposal by the end of each month to the Defendant and the Defendant shall pay the disposal expenses (Advance deposit KRW 30 million) to the Defendant. The Defendant shall be liable to pay the disposal expenses to the luminous. The term of this contract under Article 3 (Contract Period and Contract Quantity) of the same Act shall be from April to April 31, 2013 to April 31, 2014; the term of this contract shall be at least 25 minutes per month (in the event that he/she becomes aware of at least seven days without any special reason, the prepaid amount shall be deducted from the transportation expenses deposited.

2) Defendant, Plaintiff, and Dae-NC Co., Ltd. (hereinafter “UBC”)

A) A contract for the collection, transportation, and disposal of wastes on April 2013 (hereinafter “instant entrustment contract”) shall be deemed to be an entrustment contract.

(3) The Defendant, on April 10, 2013, remitted the amount of KRW 30 million, and KRW 10 million on June 13, 2013, respectively, to the large luminous Co., Ltd. on the basis of deposit of waste disposal expenses, and the large luminous Co., Ltd. treated waste amounting to KRW 34,611,577.
