The instant lawsuit is dismissed.
Litigation costs shall be borne by the plaintiff.
Reasons
1. In full view of the overall purport of the pleadings in the statements in Gap evidence Nos. 1, 3 through 6, and Eul evidence Nos. 1 to 12, the facts in the annexed sheet No. 2 can be acknowledged, Gap evidence No. 2 does not interfere with the above recognition, and no other counter-proof is otherwise asserted.
2. If so, the instant lawsuit is deemed to have been brought in violation of the non-special agreement, and thus, it shall be dismissed.
