1. Details of the disposition;

A. On May 20, 2019, the Plaintiff holding a Class I ordinary driver’s license: (a) around 23:26 on May 20, 2019; and (b) around C’s 1st day by driving a B LV car.

At the same time, the injured vehicle was stopped without taking necessary measures such as providing relief to the victim by immediately stopping the damaged vehicle after destroying the non-property of the repair cost, etc., by shocking the damaged vehicle that is parked in front of the parking place, resulting in the victim's injury such as light salt, tension, etc. of at least two weeks of treatment days.

B. Accordingly, on June 13, 2019, the Defendant revoked the above driver’s license by applying Article 93(1)6 of the Road Traffic Act to the Plaintiff on the ground that the Defendant caused the Plaintiff to have caused the traffic accident and breached its duty to take relief measures.

2. Whether the disposition is lawful;

A. On the day of the Plaintiff’s assertion at around 23:02, the instant disposition is unlawful and unfair disposition beyond the scope of appropriate discretionary authority in consideration of the following: (a) the Plaintiff was shouldered at 23:02 on the day of the Plaintiff’s assertion, and the Defendant was paid an accident while driving in order to raise high frequency; (b) the Defendant actively cooperated in the investigation; (c) currently engaged in the delivery of oil; and (d) the driver’s license is absolutely necessary because the Plaintiff was engaged in the delivery of oil; (e) the mother who was neglected due to the death of his father, who was a person of distinguished service to the State, becomes unable to capture to the hospital; and (e) the support of his family is experiencing considerable difficulties.

B. The determination of 1 punitive administrative disposition deviates from or abused the scope of discretion by social norms, which is the grounds for the disposition.
