A defendant shall be punished by imprisonment for not more than ten months.

The seized COMIVE 8GB USB 1(No. 1) shall be confiscated.

Punishment of the crime

1. From January 2014 to August 2016, the Defendant violated the Copyright Act: (a) installed in “D”, a private server operated by the Defendant, a reproduction program that is capable of “I” in the Internet online game copyright on which the program copyright is held in Jinju City C lending 303, Jinju-si, Inc.; (b) installed and operated the website (E, etc.); (c) distributed connection program that is capable of accessing the said private server while opening and operating the said website; and (d) allowing unspecified number of members of the said website to play the “I” game in the said private server using the said connection program; and (e) creating the items to the members who want to purchase the “I” item on the said game, which is equivalent to KRW 247,537,507.

B. The sales and profit equivalent to the same amount was earned.

Accordingly, the defendant infringed the victim's property right by means of reproduction and public transmission for profit-making purposes.

2. No person who violates the Act on the Promotion of the Game Industry shall engage in a business of exchanging or arranging exchange or re-purchase of tangible or intangible results obtained through the use of game water;

Nevertheless, from May 23, 2014 to April 18, 2016, the Defendant operated the private server of Nice I game as mentioned above, and used and acquired the said game among the members using the above private server, and on the part of the members wishing to receive the refund of an item, using the post office account in the name of the Defendant’s wife (Account Number G) via the attached Form No. 33,429,200 won over 151 times, such as the previous sheet No. 151.

B. A total of 35,602,70 won in 215 times in total, such as exchanging 2,173,500 won over 64 times, such as 2,173,500 won, through the Agricultural Cooperative Account in the above F name (Account Number H).
