1. The defendant is against the plaintiffs:
A. D Forest land 9,910 square meters and E forest land 162,157 square meters and prefabricated-based housing.
Reasons
1. Basic facts
A. On November 14, 2005, the Plaintiffs completed the registration of transfer of ownership with respect to D Forest land 9,910 square meters (hereinafter “the instant forest”) and E forest land 162,157 square meters (hereinafter “instant forest land”). The Plaintiffs completed the registration of transfer of ownership with respect to each of the instant forest land, including the instant forest land Nos. 1 and 2.
B. Around January 2009, the Defendant leased from the Republic of Korea the land of this case 3,091 square meters (hereinafter “instant farmland”) which is adjacent to each of the instant forests from the Republic of Korea, and entered into a lease agreement with the military unit, which was the managing authority of the instant farmland, on a part. Since April 2013, the Defendant entered into a lease agreement on the entire land with the Korea Asset Management Corporation.
Around that time, G purchased an unregistered prefabricated-type house (hereinafter “instant house”) that had been constructed on the farmland of this case from G.
C. However, in addition to the farmland in this case, the housing in this case is constructed together on the ground of "bbb" part on the ship connecting each point of the annexed drawings 1, 5, 55, 56, 7, 8, and 54, among the forest land in this case other than the farmland in this case, and on the ground of "b" portion on the attached drawings 1, 2, 3, 4, and 1, among the forest land in this case, which are linked in sequence to each point of the annexed drawings 1, 50, 51, 52, 53, 11, 12, 13, and 50, among the forest land in this case in this case and the forest land in this case 2,35 square meters.
On the other hand, the defendant, as a road for access to the farmland and housing of this case from public service, uses the attached Form 1 Map No. 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 10, 36, 37, 38, 39, 40, 41, 42, 43, 44, 44, 45, 46, 47, 48, 49, and 502 square meters (hereinafter “the passage of this case”).
