A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Fraud;

A. A. Around April 19, 2019, the Defendant committed the crime against the victim B, the Defendant made a false statement to the effect that “D” carpet in Jongno-gu Seoul Metropolitan Government, and “I will complete payment until June 23, 2019, if I lend operating funds.”

However, even if the defendant borrowed money from the victim, he did not have the ability or intent to repay it.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 7 million from the victim to the E account under the name of the Defendant on the same day, and acquired a total of KRW 17,390,000 from that time through four times, as shown in the attached crime list.

B. The Defendant committed the crime against the victim F in collusion with the victim company F, and concluded a siren contract with the victim company and received cleaning equipment from the victim company, but the Defendant provided the name of the defendant under the above contract and received KRW 300,000 in return from the above person in the name of the victim company.

Around April 16, 2019, the Defendant: (a) visited the victim company’s Internet site “G” in the French Site located in Seo-gu, Seo-gu, Gwangju; and (b) concluded a rental agreement on the condition that the Defendant would pay a rental fee of KRW 37,000 per month from April 16, 2019 to March 8, 2024 in the name of the Defendant.

Around April 25, 2019, the Defendant, by deceiving the victim as above, obtained a cleaning machine equivalent to KRW 1 million at the market price under the Seo-gu Seoul, Seo-gu H building I from the victim and acquired it by deception.

2. The Defendant forged a private document, or displayed a false security to the above B, with the intention to obtain a more loan from B by providing the above B with a false security, and attempted to forge a standard contract for the lease of a commercial building in the name of the deceased and to exercise it against B.
