A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 15, 2017, the Defendant: (a) driven a DNA cargo vehicle under the influence of alcohol by 0.172% from the 4km section from the 17:50-on the front of the apartment site that was flick-si, Gangnam-si, the Nowon-si, to the front of the same city road; and (b) the Defendant driven a DNA cargo vehicle under the influence of alcohol by 0.172%.
2. The Defendant is a person who is engaged in driving of a DNA cargo vehicle in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.
The defendant, while under the influence of alcohol as stated in paragraph 1, was driving the above cargo at the time of the daylight, as described in paragraph 1, and was driving along the two-lane road in the front of Gangnam-si, Gangnam-si.
At this point, there was an intersection where signal lights are installed, so the driver of the motor vehicle had a duty of care to safely drive the motor vehicle in accordance with good faith by accurately operating the steering and steering gear.
Nevertheless, the Defendant, while under the influence of alcohol, found it late after the victim E (the 51-year-old FM3 passenger cars) driving ahead of the victim E (the 51-year-old 51-year-old driver) driven by the victim E (the 51-year-old driver) was stopped in front of the Defendant’s vehicle due to the front color, and the latter part of the said vehicle was taken front of the fM7-year-old passenger cars, and the said vehicle was pushed down in front of the said fM3 passenger cars while driving the f3-year-old passenger car in front of the said fM3 passenger car. Accordingly, the victim G (the 63-year-old driver), who was in front of the fM7-year-old driver’s license, had the front part of the fM car in front of the fM car.
Ultimately, the Defendant driving a cargo vehicle in a situation where normal driving is difficult due to influence of drinking, and inflicts an injury on the victim E, such as salt, tensions, etc. of the trend that requires approximately two weeks medical treatment, and weak to the victim G.
