A shall be punished by a fine for negligence of KRW 1,000,000, and by a fine of KRW 1,000,000.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
[Basic Facts] The victim D is a person operating a travel agency. The travel agency operated by the person himself/herself to directly attract customers and directly guide Jeju-do travel. Defendant B is a person who directly agreed with the victim for the purpose of planning and promotion of the travel schedule, and Defendant A is a driver of the E tourist bus employed by Defendant B to guide the tour.
【Criminal Facts】
1. Defendant B, at around 18:10 on October 14, 2015, concluded that Defendant B had not agreed to receive various expenses incurred in travelling in the “G” parking lot, which is located in the Jeju city, prior to the end of the travel, Defendant B obstructed the victim’s duty of guidance by force by using the fact that the victim, who is the representative of the travel company, directly leads tourists who are customers, and directly leads them to pay the aforementioned money. The victim said, “I will stop the event and make the bus go to the police station without immediately notifying them of the premium, vehicle expenses, and the bus expenses at present,” and thereby interfere with the victim’s duty of guidance by force.
2.
