Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for eight months, respectively.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. On July 16, 2012, the Defendants’ co-offendered Defendants came to the dry field of Victim E located in Seongbuk-gun, Chungcheongnam-gun, Chungcheongnam-do, and Defendant B kn the pine trees. Defendant A sold out the surrounding soil of pine trees in advance and extracted pine trees in an amount equivalent to one million won at the market price of the victim’s possession, which is the victim’s possession, by means of camping inserted in advance.
As a result, the defendants stolen the victim's property together.
2. The sole criminal conduct of Defendant A;
A. (1) The Defendant, in violation of the Creation and Management of Forest Resources Act (1) on April 2012, extracted 1 million won per ton of pine trees from the H door owned by the G in the Gyeongbuk-gun, the market price of which is equivalent to one million won, from among the H door, which was around 12:00 on the lower end of April 2012.
(2) On May 2012, the Defendant: (a) extracted 1,500,00,000 won of pine trees owned by the GJ of the Gyeong-gun of the Gyeong-gun of the Gyeong-gun of the Gyeong-gun in the middle of May 2012; (b) extracted 1,50,000 won of the market price of the K, and loaded it on the said one ton vehicle.
(3) On May 13, 2012, the Defendant extracted 1,000,000 won of pine trees in the market price owned by K, which was around 13:00, from the day of May 2012, and later loaded into a car in the Lcco.
As a result, the defendant stolen products from forest using vehicles over three times.
B. Around 21:30 on July 16, 2012, the Defendant driven a car in the Lccoon without obtaining a driver’s license for the section of about 10km up to the front day of the Bohn-gun, Gyeong-gun, the Gccoon, which is located in the Gohon-ri located in the ancientbuk-gu, the Gccoon (1) around 21:30, 2012.
(2) On July 16, 2012, at around 23:00, the Defendant driven a car in the above column without obtaining a driver’s license from the section of about 10 km, which is located in the ancient city located in the ancient city located in the ancient city located in the ancient city located in the ancient city located in the front of the ancient city located in the Man-ri in the front of the Man-gun, Chungcheongnam-do.
