The defendant's appeal is dismissed.

1. The summary of the grounds for appeal (the imprisonment without prison labor for eight months and the suspension of execution for two years) of the lower court is too unreasonable.

2. The judgment of the court below is the primary crime of the defendant, agreed with the victim's bereaved family members, and the victim's negligence in the occurrence of the traffic accident of this case seems to exist to some extent. However, the defendant's crime of this case resulted in the result that the victim's death cannot be observed due to the crime of this case, the defendant's negligence committed in violation of his duty of care at night and committed an intersection by violating the signal. The court below seems to have sentenced the suspension of execution of imprisonment without prison labor considering the above favorable circumstances of the defendant. The court below's punishment is not unfair in full view of all the sentencing conditions as shown in the records and arguments of this case including the defendant's age, character and behavior, living environment, relationship with the victim, the means and consequence of each crime of this case, and the circumstances after the crime of this case.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
