1. 성폭력범죄의처벌등에관한특례법위반(공중밀집장소에서의추행) 피고인은 2016. 8. 9. 08:39경 서울 관악구 남부순환로 1822에 있는 지하철 2호선 서울대입구역 방면에서 서울 동작구 남부순환로 지하 2089에 있는 사당역 방면으로 이동하는 전동차 안에서 피해자 D(여, 23세)의 뒤쪽에 서서 오른손으로 피해자의 엉덩이 부위를 한 차례 만지다가 흥분한 나머지 바지에서 자신의 성기를 꺼내 오른손으로 자위행위를 하는 과정에서 손으로 피해자의 엉덩이 부위를 톡톡 쳤다.
