The appeal is dismissed.

The grounds of appeal are examined.

1. According to the records as to the violation of the Act on the Assembly and Demonstration due to the participation in the night demonstration, the summary of the facts charged as to the violation of the Act on the Assembly and Demonstration due to the participation in the night assembly and demonstration has been held at night from October 2007 to 24:00 on the same day. Defendant A made an outdoor assembly and demonstration at night. From October 21, 2007 to October 21, 2007 to 24:00 on the same day, the court below reversed the part of the facts charged as to the Defendants’ respective charges of violation of the Act and found the Defendants not guilty of the facts charged as to the violation of the Act on the Assembly and Demonstration from around 21:00 to 24:00 on October 12, 207, and remanded to the court below that found the Defendants not guilty of the facts charged as to the violation of the Act on the Assembly and Demonstration at night. The court below reversed each of the aforementioned part of the charges as to the Defendants’ respective participation in the Assembly and Demonstration at night.
