A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In using and managing the means of access, no person shall borrow or lend a means of access or keep, deliver or distribute a means of access with the knowledge that the means of access is to be used for a crime or will be used for a crime.

On July 25, 2019, the Defendant received text messages from a person with no personal name and received a loan from a person with no personal name, and proposed that “a loan can be made at the rate of 3% per month. It is a method of self-payment of principal and interest. It is the method of paying interest every month, and the Defendant sent a check card connected to the account under the name of the Defendant, and if the interest is deposited into the said account, he/she would withdraw interest by using the said check and return the card after repayment of principal and interest.”

In order to obtain loans in the past 2015, the Defendant was aware that, in response to the proposal that the account was opened to the police in order to use the Defendant’s account number, password, and physical card, the Defendant could use the Defendant’s account number, password, and physical card in the crime of scaming, if the account was transferred without permission to the person under whose name the account was used for fraud.

Nevertheless, the Defendant, after accepting the proposal of the person who has failed to obtain the above name, notified the person who has failed to obtain the above name of the Defendant of the password, and sent one physical card connected to the above account by using the phone line at the Taekk-si post office located in 173, 16:08, Seok-si, Gangwon-do, Gangwon-do, Gangwon-do, which is located in 173, to the person who has failed to obtain the name.

Accordingly, the Defendant lent the means of access knowing that it will be used for crime purposes or crime.
