A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 11, 2011, the Defendant issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act at the Seoul Western District Court, and a summary order of KRW 2 million for a crime of violating the Road Traffic Act at the Seoul Western District Court on May 8, 2018.

1. On September 10, 2018, the Defendant violated the Road Traffic Act (drinking) and the Road Traffic Act (DCA 110B 10B 108CC 108CC 108, a bicycle under the influence of alcohol leveling 0.146% in blood alcohol level on the front road of Seodaemun-gu Seoul, Seoul, without obtaining a license for a motor device bicycle at around 20:45 on September 10, 2018.

As a result, although the defendant had been punished for driving under drinking more than twice, he again driven a motor bicycle without obtaining a motor device bicycle license under the influence of alcohol.

2. The Defendant is a person engaged in driving a bicycle with DCA110B 10B 108CC engine equipment owned by ABC Co., Ltd. (the injury caused by dangerous driving) in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.

On September 10, 2018, the Defendant driven the motor device bicycle under the influence of alcohol level of 0.146% from the blood alcohol level of 0:45 on September 10, 2018, and led the front road of Seodaemun-gu Seoul to an elementary school from the long distance from the northwest-gu Seoul to the right side of the road.

At night and its location was narrow side. In such a case, a person engaged in driving a motor device bicycle has a duty of care to check whether there is a vehicle on the road that he/she intends to enter by reducing speed in advance and driving on the front side and the right side, and to properly manipulate the brake and steering gear so as to prevent the accident from spreading.

Nevertheless, the defendant was making a stop in order to circumvent to the front bank due to negligence while under the influence of alcohol.
