Reasons
1. Basic facts
A. D was prosecuted as a crime of fraud for the following criminal facts:
Defendant (D) had loan applicants who are unable to receive a loan in a normal manner be able to obtain a loan by guaranteeing each other, and one person is able to receive a brokerage fee, and one person is able to contact loan applicants and provide loan counseling. The F plays a role in receiving a fee when meeting loan applicants and paying a loan deposit. The Defendant received documents related to the loan and submitted them to the lending company and received a confirmation telephone of the lending company on behalf of the male loan applicants, and G conspired to play a role in receiving a loan on behalf of the loan applicants on behalf of the loan applicants on behalf of the loan applicants.
Around November 7, 2016, the Defendant: (a) requested the Defendant to provide a loan or loan at the J coffee shop located in Busan Seo-gu, Busan; (b) received relevant documents, such as identification card, resident registration certificate, and deposit transaction statement, from the Defendant via F; (c) submitted relevant documents, such as identification card, resident registration abstract, and deposit transaction statement, from the other loan applicant K; and (d) submitted them to the L Co., Ltd., which is the lending company; (c) requested each loan applicant to transfer the mobile phone to the Defendant and G number; and (d) notified each loan applicant to transfer the mobile phone to the Defendant and G number; and (e) conducted the loan as if the Defendant was the Defendant after obtaining the personal confirmation phone from the Defendant; and (e) G conducted as if the Defendant was the Defendant.
However, the defendant and K, who applied for a guarantee loan to the victim company, were not aware of each other, and the defendant was unable to receive a loan in a normal way.
The Defendant, as above, in collusion with E, F, and G, is the victim.
