A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On October 5, 2016, the Defendant sent a false statement to the victim C, who reported and contacted the writing, stating that “I will sell the LG plex 2 mobile phone” on the Internet evaded NA bulletin board at the end of the city of 2016. The Defendant sent a mobile phone to the victim C who first deposits money.
However, in fact, the defendant did not have 2 mobile phones at the time of posting the article, and even if he received the price, he did not have the intention or ability to deliver the mobile phone to the victim.
The Defendant, by deceiving this victim, received KRW 90,00 from the injured party to the Nonghyup Bank account in the name of the Defendant in the name of the purchase price for goods at around 12:00 on the same day, and received KRW 3,075,000 in total from that time until February 5, 2017 by the same method as indicated in the list of crimes in the attached list of crimes.
On January 31, 2017, the Defendant posted a letter stating that “G5 mobile phone is sold” on the Internet evasion NA’s bulletin board and made a false statement that he/she would first deposit money to the victim D who reported and contacted the text.
However, the defendant did not have G5 mobile phones at the time of posting the article, so even if he receives the price, he did not have the intention or ability to deliver the mobile phone to the victim.
The Defendant, by deceiving the said victim, received KRW 200,000 from the victim to the Jeju bank account under the name of E in the name of the same day from the victim, and received KRW 3,022,00 in total from November 18, 2016 to February 11, 2017 by the said method as indicated in the list of crimes in attached Form 12 times.
