A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

가. 2018. 10. 15.자 범행 피고인은 2018. 10. 15. 00:50경 여수시 B 소재 피해자 C 운영 D에서 맥주 1병을 주문한 후 “양주 1병을 시키면 몇 번이나 키핑이 되냐. 사이드 메뉴만 시켜도 되냐”라고 물은 것에 대하여 피해자가 키핑은 가능하지만 키핑요금 3만원이 든다고 답하자 피해자에게 약 15분 동안 “사이드 메뉴도 안 되고 키핑요금을 받는 게 어디 있냐 씨발 좃같네”라고 큰소리로 욕설을 하여 가게 안의 손님들이 밖으로 나가게 하였다.

B.
