Reasons
1. Basic facts
A. As to the Plaintiff’s claim against E (1) the registration of the establishment of a mortgage on August 31, 2005 with respect to each of the real estate listed in the separate sheet (hereinafter “each of the instant real estate”), the registration of the establishment of a mortgage against the mortgagee was completed on August 31, 2005, with respect to the maximum debt amount of KRW 351,00,000,000,000, and the debtor E and the non-party non-party-mortgage agricultural cooperative. B. On April 6, 2010, the Defendant’s mortgagee completed the registration of creation of mortgage (hereinafter “the mortgage of this case”) with the mortgagee, the obligor, the obligor E, the claim amount of KRW 500,00,000, due date for payment on April 5, 2010 on the ground of the mortgage agreement on April 5, 2010 regarding the real estate listed in the separate sheet Nos. 1, 3, 4, 6, 7, and 8 and the real estate listed in the separate sheet No. 9 of the separate sheet No. 1, 2010.
