1. The defendant,
A. As to KRW 41,817,080 and KRW 40,000 among them, Plaintiff A:
B. Plaintiff B: KRW 51,811,740.
Reasons
1. Basic facts
A. At around 2006, Plaintiff A became aware of the Defendant at the Koditer group of the hospital, and Plaintiff B became aware of the Defendant through the introduction of Plaintiff A around January 2012.
B. The Defendant, along with the Defendant’s non-speed F, running the point of "E" in Gwangju Northern-gu, shall provide adequate profits from the Defendant’s will, including the Plaintiffs. (1) From December 26, 2010 to February 3, 2012, issued by the Plaintiff KRW 83 million on seven occasions as indicated below. The amount agreed upon on the date of delivery of the sequence 18 million on December 26, 2010; KRW 3.6 million on March 30, 201; KRW 4 million on March 30, 201; KRW 7 million on March 16, 201; KRW 7 million on April 29, 2000; KRW 7 million on October 16, 2011; and KRW 7 million on March 1, 2000, KRW 500000 on March 30, 2011.
C. On June 24, 2015, the Defendant filed a complaint against the Defendant and F in fraud. On June 24, 2015, the Defendant was convicted of the Defendant’s criminal facts related to the Plaintiffs in the Gwangju District Court 2014No2697 (No. 1735 of the first instance judgment), 1 of the criminal facts related to the Plaintiffs, 30 million won in total, among the amount acquired through deception against Plaintiff A, and 2 of the judgment of conviction against Plaintiff B.
Meanwhile, on June 14, 2012, the Plaintiffs filed a lawsuit against the Defendant for loans (hereinafter “related civil lawsuit”) with the Gwangju District Court 2012Kahap7276, and the Defendant filed for bankruptcy with the Gwangju District Court 201Hadan3618 on December 28, 2012 and was declared bankrupt by the said court on July 12, 2013.
E. The Plaintiff changed the relevant civil lawsuit into a lawsuit for confirmation of bankruptcy claim, and the Gwangju District Court on January 22, 2016 to "Bankruptcy Debtor C," and the Plaintiff A on January 42, 986 to "A," respectively.
