피고인은 2013. 2. 7.경부터 2013. 2. 13.경까지 대전 동구 C 건물 2층에서 상호가 없는 게임장을 운영하면서 외관상 ‘사냥꾼’ 게임기(35대), ‘오션2포커’ 게임기(30대), ‘노세노세’ 게임기(4대), ‘플라맹고포커’ 게임기(1대)를 설치한 후 실제로는 등급 분류를 받지 아니한 사행성 유기기구인 ‘바다이야기’ 게임물을 설치하여 불특정 다수의 손님들로 하여금 게임기에 돈을 넣고 게임을 시작하면 우연히 고래상어 등의 등장에 따라 특정한 점수를 획득하는 방법으로 게임을 하게 한 후 손님들이 취득한 상품권 1장에 대하여 10%의 수수료를 제한 4,500원으로 환전하여 줌으로써 사행성 유기기구를 이용한 사행행위 및 게임물의 이용을 통하여 획득한 유무형의 결과물을 환전하는 행위를 업으로 하고, 등급을 받지 아니한 게임물을 이용에 제공하였다.
