A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. On August 17, 2020, the Defendant, at around 19:00, obtained one “IBK Enterprise Bank Love Card (E)” in the market price on which the victim D lost before the exit point near C Station No. 5 located in Busan Dong-gu, Busan, with the intention to obtain it without returning it to the victim or reporting it to the police authorities.

Accordingly, the defendant embezzled the property that has been separated from another person's possession.

2. On August 17, 2020, the Defendant violated the Specialized Credit Financial Business Act: (a) around 19:17, 2020, at the coffee vending machine administered by the victim GK Company established in Busan Dong-gu, Busan, recognizing D’s voluntary credit card lost as described in paragraph (1) to the payment system, such as credit cards installed on the said vending machine; (b) up to 300 won of the market price; and (c) from that time until August 20, 2020, removed self-owned goods such as drinking water, etc. totaling 51,300 won of the market price from August 11:12, 2020.

Accordingly, the defendant stolen the property owned by the victim G&S company and used the lost debit card, etc.

3. On August 19, 2020, at around 07:52, the Defendant violated the Specialized Credit Financial Business Act: (a) put the victim I corporation’s unmanned goods stored in C basin H located in Busan Dong-gu, and (b) put the IBK Enterprise Love Card, which D lost, into the credit card settlement system installed in the storage of the goods, as described in paragraph (1); and (c) settled the amount of KRW 5,000 for the use of the goods stored.

As a result, the Defendant, without authority, entered information on the above IBK Bank Love Card, which is an information processing unit such as computer, into the above IBK Bank Love Card, and processed the information, thereby making the victim use the information amounting to 5,00 won.
