피고인은 2017. 1. 26. 01:20 경 대구 달서구 B에 있는 C 지구대 앞 도로에서 C 지구대에서 소속 경장 D(38 세 )로부터 ‘ 택시요금을 지불하고 귀가 하세요’ 라는 말을 듣자 이에 화가 나 "야 이 씨 발 새끼야, 맘대로 해 라, 이 새끼들 아 내가 안에 들어가서 깽 판 한 번 쳐 보자, 이 새끼야" 라며 욕설을 하고, 이를 제지하는 위 D에게 " 이 새끼야 한판 붙어 보자 "라고 말하며 두 손으로 위 D의 가슴을 밀치고, 손으로 멱살을 잡는 등 폭행하여 경찰관의 범죄 예방 및 처리 등에 관한 정당한 직무집행을 방해하였다.
