A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around August 25, 2017, the Defendant violated the Road Traffic Act (breathing) driven a DNA car with a alcohol content of about 383 meters from a section of approximately 500 meters, 0.165% while under the influence of alcohol, from a section of approximately 500 meters to the front of C in the building B through the building B in the same Gu.
2. Around August 18, 2017, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) led the front road B located in B while driving the said small-scale car and driving it in the direction of the right distance from the horizontal distance direction.
Since a signal, etc. is installed, and the operation of other vehicles is frequent, the driver of the vehicle has a duty of care to prevent accidents in advance by accurately manipulating the brake system after living well on the front side and the left side of the vehicle.
Nevertheless, the Defendant neglected to pay alcohol to Defendant E (54) while driving the FMW 528i car driven by the victim E (54) who had been driven by Defendant E (54) but stopped due to the stop of the said BMW 528i car, due to the negligence of running the said BM 528i car, received the back part of Defendant E’s vehicle as the front part of the passenger car.
Ultimately, the Defendant driven the said small-scale car in a state where normal driving is difficult due to influence of drinking, and suffered from the victim G (3) who was on the back seat of the said BMW 528i car in need of a two-day medical treatment, respectively.
