1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On December 24, 2004, the Defendant entered into an insurance contract on the attached list No. B with the insured as the Defendant’s wife B (hereinafter “instant insurance contract”).
B. B, as indicated in Table 1, was hospitalized in C Hospital for 8 days from December 18, 2007 to December 25, 2007, as well as for 451 days until September 29, 2014. However, the Plaintiff calculated the total number of hospitalization days as 605 days by calculating the number of hospitalizations in duplicate as stated in Table 1, Nos. 12, 14, 25, and 31.
The Defendant received insurance money of KRW 36,88,817 in total from the Plaintiff in relation to the above hospitalization treatment.
