1. Of the judgment of the court of first instance, the part against the plaintiff ordering payment is revoked.

1. Occurrence of liability for damages;

A. The facts of recognition (1) Party C (hereinafter “the deceased”) is a person who died of the instant fire accident, and the Plaintiff is his/her spouse, who was the sole heir following the agreement on the division of inherited property on August 28, 2017.

(2) On March 11, 2014, the deceased, who was unable to move alone alone due to the elderly age of 81 years of age, was boomed and mixed on the part of the Defendant’s national electric ground board (hereinafter “the instant electric ground board”) located inside the house located in Yeongdeungpo-gu Seoul, Seoul (hereinafter “instant house”) located in the residence of the deceased, and died on March 14, 2014 due to a fire that occurred in the instant electric ground board (hereinafter “the instant fire”). Accordingly, the deceased died around 15:50 on March 14, 2014.

(3) 이 사건 화재 현장의 상황 (가) 영등포경찰서의 현장감식결과 - 이 사건 화재현장은 당시 안방 내부 전체에서 그을림이 관찰되고 그 방바닥에서 일부 소훼된 전기장판이 전원이 켜져 있는 상태로 겨울이불 위에 놓여 있었음. - 이 사건 전기장판 컨트롤박스는 4단 상태에서 전원이 켜져 있고 그 전기장판 위에 또 다른 이불이 소훼된 상태로 관찰되었음. - 이 사건 화재 당일 아침에 이 사건 전기장판에 노랗게 그을린 자국이 있었다는 원고의 현장진술 및 방바닥에 깔려있던 겨울이불 위에 전기장판을 4단으로 켜 놓고 그 위 또 다른 겨울이불이 올려져 있었다는 진술과 그 전기장판 부위가 소훼된 점으로 보아 전기장판 과열에 의해 발생한 화재로 추정됨. (나) 영등포소방서의 화재현장조사결과 - 발화지점 : 안방 방바닥에 깔아놓은 이 사건 전기장판 및 그 위에 놓여 있는 이불의 일부가 심하게 탄화되어 잇는 것으로 보아 발화기기는...
