A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
In using and managing a means of access, no one shall lend the means of access while receiving, demanding or promising any compensation, unless otherwise specifically provided for in any other Act.
Nevertheless, the Defendant, on August 27, 2019, leased his personal account from a person who misrepresented himself to a liquor company for the purpose of recovering alcoholic beverages prices. In short, the Defendant listened to the statement that he would give KRW 3 million per the face-to-face account for three days in a short period, packing a cam card, and send it to a person who is in the front of the present official, who is not in the position of the present official. On the 30th day of the same month, the Defendant packaged the cam card connected to the Defendant’s bank account (E) in the front of the office of the Defendant in Daegu-gun Military Building, and the Defendant in subparagraph (C), and then sent the cam card to the name-to-face and the password to the name-to-face in the manner of packing the d bank account under the name of the Defendant.
As a result, the defendant promised to pay compensation and lent the means of access to his name in return.
