Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The injured party B is a person operating a delivery company with the trade name "D" in the Busan Western-gu, Busan, and the defendant was found to have been aware of to work with the above company.

1. On March 2018, the Defendant found the “D” office operated by the victim, and made a false statement to the victim stating that “I want to serve as delivery date. I wish to pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will pay I will.”

However, the defendant did not have the intention of delivery date, and even if the victim pays the price on behalf of the defendant, he did not have the intention or ability to pay it.

As such, the Defendant, by deceiving the victim, had the victim pay 2.5 million won in lieu of the victim, and had the victim pay 2.5 million won in lieu of it.

2. The Defendant, at the end of March 2018, lost the Oral Ba purchased as stated in the foregoing paragraph (1) at the “D” office, demanded the Defendant to temporarily use the Oral Ba in the office on the delivery date, so that the Defendant would be able to temporarily use the Oral Ba in the office, which is equivalent to KRW 500,000,000 in the market price owned by the victim, for two days on the delivery date, used it on the delivery date, and did not return it to the victim.

Accordingly, the Defendant embezzled 50,000 won of the victim's 500,000 won.
