1. Basic facts
A. The Plaintiff is a juristic person established around March 25, 2005 and engaged in bathing and hot spring supply business in the area B located in the area B located in Chungcheongnam-gun, Chungcheongnam-gu. The Plaintiff was dissolved on December 3, 2012. The Defendant is a juristic person which was dissolved on December 3, 2012, and the Defendant is a hot spring hole of 1 (D), 3 (E), and 4 (F) hot spring hole 2 (K) out of the four hot spring holes within the said area, and supplied hot spring water exclusively operated by the said company.

B. On October 19, 2001, the C District Land Partition Co., Ltd. entered into an additional agreement on the construction of hot spring supply facilities (such as the excavation of hot spring hole and the installation of hot spring water supply pipe, etc.) on February 15, 2002, with respect to the construction of hot spring supply facilities and the subsequent progress thereof, in order to implement a land readjustment project in the C District at the area of 225,300 square meters in Gyeong-gun, Chungcheongnam-gun, Seoul, G, and H in accordance with the C Tourist Site Development Plan.
Sheshe newly built one water pumping room and one management office building on the ground of 1,17.6 square meters in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do. However, the Land Partition Association built the above building without obtaining approval from the Gyeongnam-do, and as a result, up to the present time, the above building was maintained as unregistered and unauthorized buildings.
