1. The defendant,
A. The Plaintiff A’s KRW 45,292,610 as well as 5% per annum from December 17, 2016 to August 13, 2018.
Reasons
1. Details, etc. of ruling;
(a) Authorization for project implementation, etc. - Project name: Cfinancial rain promotion zone redevelopment improvement project - Project implementer: Defendant - Public notice of authorization for project implementation: D public notice of Seongbuk-gu Seoul Metropolitan Government on December 3, 2013;
B. Adjudication on expropriation made on October 28, 2016 by the local Land Tribunal of Seongbuk-gu Seoul Metropolitan City: ① Plaintiff A-Seoul E- 460.3 square meters, its ground buildings, trees, etc. (hereinafter “land subject to expropriation of Plaintiff A”) and ② Plaintiff B- G302, which is a sectioned building on the F ground (including a transition area: 67.08 square meters, site ownership, and common area; hereinafter “Plaintiff B’s object subject to expropriation”) - The date of the commencement of expropriation: December 16, 2016 - Plaintiff A’s compensation for expropriation: Plaintiff A1,594,658,590 won (=land 1,429,231,500 won) and land 165,427,409,200,206,2000 won and 2006,000 won (hereinafter “land 1,429,500 won)
(c) The Central Land Tribunal’s ruling on an objection made on November 23, 2017 - The compensation for losses: Plaintiff A 1,618,232,140 won (i.e., land KRW 1,447,643,500) (i.e., KRW 170,58,588,640), Plaintiff B214,600,000 won - Expert’s ruling on an objection: The Korea Land Tribunal and the Korea Land Appraisal Corporation and the Korea Land Appraisal Corporation;
D. The court appraiser 1 of the appraiser H’s appraisal result (hereinafter the above appraiser “court appraiser”) and the above appraiser 1 of the court appraiser of the court appraisal (hereinafter “court appraisal”) shall select the land E among the objects under confinement A as a comparative standard and apply the market score politics considering the price fluctuation rate of the land adjacent to J (specific use area: Class 2 general use area, land size 15.4 square meters of land size, time of transaction: October 16, 2015) by selecting the land of the Plaintiff as a comparative standard and comparing the land of the same or similar use area, use status, surrounding environment, etc. (land category: large, specific use area: Class 2 general use area, specific use area: small, road traffic, etc.) with respect to the land of the Plaintiff A (hereinafter referred to as “land subject to transaction case”).
