A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who illegally issues a passport shall enter false facts in a document submitted to have a passport issued or reissued, or use other unlawful means to have a passport issued or reissued;

Nevertheless, at around 17:30 on July 20, 2016, the Defendant entered false facts such as “B”, “B”, “B” in the English name column, and “B” in the resident registration number column, and attached the Defendant’s photograph to the public official in charge of the name misstatement, and submitted it to be issued a Korean passport ( passport number D) in the name of B under the name of the Defendant.

Accordingly, the defendant was issued a passport by illegal means.

2. Illegal events of passports and illegal immigration persons shall not use another person's passport, and nationals who intend to depart from the Republic of Korea to an area outside the Republic of Korea shall obtain a departure inspection conducted by an immigration control official at the entry and departure port where they depart with a valid passport, and nationals who intend to enter the Republic of Korea in an area outside the Republic of Korea shall undergo an entry inspection conducted by the immigration control

Nevertheless, on August 3, 2016, at the Incheon Central Airport located in Jung-gu Incheon, 272, the Defendant presented a passport under the name of B issued as described in paragraph (1) to a public official of immigration control in the name of the Republic of Korea after undergoing an examination of departure from Australia, and received a departure inspection using the valid passport, and also presented a passport under the name of B as shown in the separate sheet of crime from September 26, 2019 to September 26, 2019, as shown in the separate sheet of crime Nos. 1, 3, 5, 7, 9, 11, 13 using the valid passport, and received a departure inspection as shown in the separate sheet of crime Nos. 2, 4, 6, 8, 10, 12, and 14 of the remaining list of crimes.
