피고인은 2014. 10. 31. 00:15경 광주시 B에 있는 피해자 C(23세)이 운영하는 D 편의점에서 술에 만취한 상태로 위 편의점 안으로 들어와 피해자에게 경찰을 불러줄 것을 요구하였고, 피해자가 안 된다고 하며 편의점 내부의 사무실 안으로 들어가자 그 안 까지 쫓아와, “너희 아버지뻘 인데 왜 그러냐 나이도 어린 게 어디서 그러냐 이 새끼 안 되겠다.”라고 소리치며 피해자의 안경을 벗기고 손바닥을 들어 따귀를 때릴 듯이 위협하는 등 약 10분간에 걸쳐 소란을 피워 손님들이 출입을 하지 않게 하는 등 위력으로 피해자의 편의점 영업 업무를 방해하였다.
