Punishment of the crime

From March 2012 to March 10, 2015, the Defendant was in office as the secretary of the labor union of the limited partnership company C in Bupyeong-gu Seoul Special Metropolitan City, Busan Special Metropolitan City, and was engaged in the collection, disbursement, and management of the union expenses, ordinary investigation expenses, and expenses incurred in the control of other City/Do taxi operations.

1. Around October 5, 2012, the Defendant embezzled funds from union members by arbitrarily withdrawing KRW 700,000 in cash at the auxiliary point of the community credit cooperatives and using them as living expenses, etc. from around August 1, 2013 in the same manner, from around 19 times to around August 1, 2013.

2. Around September 25, 2013, the Defendant embezzled a total of KRW 9,750,000,000 in total, from around 10 times until March 5, 2015, from among the following means: (a) while he/she was in the occupational custody of the said association for the sake of the said association, he/she arbitrarily withdrawn KRW 600,000 in cash from the father branch of the community credit cooperative to use it as living expenses, etc. at the expense of the victim; and (b) he/she arbitrarily consumed and embezzled a total of KRW 9,750,000 in total by the same method until March 5, 2015

3. Around March 7, 2013, the Defendant embezzled expenses incurred in regulating other taxi operations in the name of D and embezzled KRW 3,90,000 in total eight times by arbitrarily consuming the total amount of KRW 3,00,00 in the same manner until September 3, 2013, as shown in the List of Crimes (3) in the same manner, while the Defendant kept the expenses for regulating other taxi operations in the name of D community credit cooperatives (Account Number: G) for the said association, the victim, as the victim.
