The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. In regard to defamation around April 11, 2012, around April 201, around April 201, and around August 2012, 2012, there was no fact that the Defendant made a statement against the victim as stated in the facts charged in the instant case, and in particular, as for defamation around April 2012 and around August 2012, the Defendant made such statement.
Even if there is no performance, the defendant cannot be deemed to have damaged the reputation of the victim, and ② assault, and the defendant did not have any fact at the time of the victim, the judgment of the court below which found the whole facts charged of this case guilty of the facts and affected the conclusion of the judgment.
B. The sentence imposed by the lower court on the grounds of unreasonable sentencing (three million won of fine) is too unreasonable.
2. Determination
A. 1) As to the assertion of mistake of facts, we examined the assertion that there was no fact as described in the facts charged in the instant case. 1) The Defendant, from the police investigation conducted on July 22, 2013 to the police investigation conducted on or around April 11, 2012, he tried to see the victim by hand as to whether the Defendant could show the telephone list on the cell phone and handle the telephone for the year to the end of the judgment (Evidence Record 87 pages), and around April 2012, G told G to the effect that “the reason suspected of the Defendant’s husband’s relationship with the victim” (Evidence Record 85 pages), and that “I would be good if it would not cause any damage to the family” around August 2012.
(86 pages) The statement to the effect that it appears true that the defendant made a statement to the effect that the victim, G, and H had the wind with the husband of the defendant, or made a statement containing such meaning. ② The victim, G, and H’s statement to the effect that the victim took place the defamation of this case was made in a specific and detailed manner to a certain extent, and the explanation of the situation is reasonable, and the investigation is conducted at the investigation stage.
