The judgment below

Examining the reasoning of the lower court and the first instance court in light of the evidence duly admitted, the lower court is justifiable to have found the Defendant guilty of the instant facts charged on the grounds stated in its reasoning. In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by misapprehending the bounds of the principle of free evaluation of evidence by exceeding the bounds of the principle of logic and experience

In addition, the ground of appeal asserts that the court below erred by violating the provisions of the law, among the grounds of appeal, since the defendant's ground of appeal did not state it as the ground of appeal or the court below did not consider it as the subject of judgment ex officio, it cannot be a legitimate ground

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
