1. The plaintiff's appeal and the claims added by this court are all dismissed.

The grounds for appeal by the plaintiff citing the judgment of the court of first instance are not significantly different from the allegations in the court of first instance, and even if each evidence submitted to the court of first instance was presented to this court, it is difficult to change the facts and judgment recognized by the judgment of the court of first instance.

Therefore, the reasoning of the judgment of this court is as follows, except for the judgment of this court as to the claim for damages added by the plaintiff in this court, and therefore, it is justified in the judgment of the court of first instance.

The plaintiff's decision on the claim added by this court is reversed due to the defendant's fault, and therefore, the defendant asserts that the plaintiff should compensate for the amount of KRW 26,950,000, which is part of the total of KRW 26,950,543, which is part of the plaintiff's total of KRW 26,950,000,000 paid by the plaintiff to withdraw the M real estate auction case.

According to the statements in Gap evidence Nos. 16 through 28, it is recognized that the plaintiff disbursed a total of KRW 26,950,543 as alleged above.

However, as seen earlier, insofar as it is difficult to recognize that the instant contract was reversed due to the Defendant’s fault, it cannot be said that the Defendant is liable for damages.

Therefore, the above claim of the Plaintiff cannot be accepted on a different premise.

3. The plaintiff's claim of this case must be dismissed as it is without merit.

The judgment of the court of first instance, which dismissed the plaintiff's existing claim, is justifiable with this conclusion. Thus, all of the plaintiff's appeal and the claims added by this court are dismissed. It is so decided as per Disposition.
