1. The Defendant’s KRW 58,190,00 for the Plaintiff and KRW 20% per annum from February 25, 2015 to September 30, 2015.
Reasons
1. The following facts may be acknowledged in the absence of dispute between the parties, or in full view of the entry of the evidence No. 1 and the testimony of the witness A, the whole purport of the pleadings:
The plaintiff is a corporation that operates broadcasting stage, set design business, production business, etc., and the defendant is a corporation that produces various video works, such as drama and film.
B. On September 22, 2014, the Defendant entered into a contract for program production-related services (hereinafter “instant service contract”) with the Plaintiff with respect to the set services for “B” production scheduled to be broadcasted by the cable broadcasting station TVN, and the relevant part of the instant service contract is as follows.
Section 1 (Purpose) of the Services for the Production of Yongsan Station C from the date of conclusion of the contract term to the date of the broadcast of “program” from the date of conclusion of the contract term for the Plaintiff Program B-type 60 minutes of the Plaintiff Program C-type 60 minutes to the date of the broadcast of “Program A”
2. The scope of “services” includes all labor costs, equipment, expendable items and all other costs.
Article 2 (Service Fees and Payment Method)
1. A shall pay to B service charges for “services” after entering into a contract, as follows:
Service charges of KRW 248,50,000 (excluding value-added tax) includes all the expenses, such as set materials / food / transportation / oil / parking fees, etc. under the terms and conditions of the service under the detailed contract terms and conditions of the contract. All the expenses for all types (including 29,00,000 for photographing)/steping. Additional expenses (29,000 for photographing)/steping shall be included within the extent agreed upon by the Party A. The scope of payment at actual expenses: Where a new set is incurred in excess of the additional set expenses, and the cost for outdoor typeing is settled separately (40%) at the time of payment. By October 6, 2014: 9,400,000 (Additional dues): 9,400,000 won until November 7, 2014; 200,0000 won and 30,0000 won after additional broadcasting (20: 30:00,0000 won after additional broadcasting (20: 4.20.1.20%)
