1. Of the judgment of the court of first instance, the part against the defendant exceeding the following amount ordered to be paid shall be revoked.

1. Facts of recognition;

A. The Plaintiffs, as the parties, invested in a new construction project, such as the Daegu Suwon-gu D, E, and F Daegu Suwon-gu D large 119 square meters, E large 795.7 square meters, F large 234.7 square meters, etc. (hereinafter “G Dong-sale project”), and a new project, such as a new project for the said project site (hereinafter “Gdong-sale project”).

The defendant is the project implementer of the above Gdong sales business and the sales agency of the Idong sales business (Idong sales business operator) and K is the person who actually operates the defendant and the J.

B. (1) The Plaintiff entered into a sales contract with the Defendant for Gdong sales (hereinafter “G Dong sales contract”) and an investment contract for the Idong sales business (hereinafter “I Dong investment contract”) as follows, and around that time, Plaintiff A paid KRW 200 million in total to the Defendant as the down payment pursuant to G Dong sales contract (on the first order), and KRW 100 million in total (on July 17, 2015, KRW 100 million (on the first order) as the investment deposit pursuant to the Idong investment contract.

On May 1, 2015, Gdong apartment M& 365,300,000 won of the down payment of KRW 50 million on July 29, 2015, the sales contract was concluded with the Defendant on August 29, 2015, and on August 6, 2015, G apartment N No. 383,33,000 won of the down payment of KRW 45,300,000 won on August 22, 2015, the Plaintiff paid KRW 30,30,000 won in total, including the down payment and the intermediate payment, to the Defendant at that time, as follows.

On April 14, 2015, the title and amount of the sale price of the object of the contract, which was KRW 370,30,000,000,000 KRW 50,000,000,000 of the contract deposit for the apartment P of G Dong L L L on April 14, 2015, KRW 252,00,000,000 KRW 50,000,000 for the contract deposit of KRW 34,060,000,000 on August 12, 2015, G apartment RR-ho 234,060,860, KRW 50,000,000 for the intermediate payment, KRW 30,000,00.
