1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On November 19, 2013, the Defendant and the Youngjin Construction Co., Ltd. (hereinafter “Yjin Construction”) entered into a contract with C Co., Ltd. (hereinafter “D”) to set the contract amount of KRW 1,351,00,000 for the instant primary construction project (hereinafter “instant primary construction project”) between the contract amount to KRW 1,351,00,000 (a value-added tax separate. Payment of KRW 100,000,000,000,000, out of the said money is KRW 50,000,000 as advance payment, and the construction period from January 27, 2014 to April 27, 2014.
B. D entered into a contract with F to re-subcontract the instant primary construction project, and on March 10, 2014, transferred to F the instant claim for construction price of KRW 1,351,000,000.
C. On May 8, 2014, Youngjin-si entered into a contract with D to enter into a contract to set the contract for the construction of three lots of housing units (hereinafter “the instant secondary construction”) at the contract price of KRW 1,645,00,000 (the value-added tax is separately paid and KRW 100,000,000,000,000, out of the said money, shall be paid in advance to three stories), and the construction period from May 8, 2014 to October 8, 2014, and D resubcontract the instant secondary construction to F.
F had undertaken the instant primary construction and completed it around October 2014, and the Defendant completed the registration of initial ownership on October 23, 2014 in its own name as to the E-dong reinforced concrete roof, and the E-dong reinforced concrete roof, and the E-dong reinforced concrete roof, and the urban living housing with three floors of reinforced concrete structure (hereinafter referred to as the “instant Baradong”).
E. On the other hand, the defendant and Youngjin-gu shall pay F the first construction cost of the instant case to F, KRW 10 million on February 4, 2014, and the same year.
2.6.6.6 million won, and the same year;
2.7.30 million won, and the same year;
3.13. 50 million won, and the same year.
4.25.80 million won;
