Defendant shall be punished by imprisonment for a term of one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. 특정범죄가중처벌등에관한법률위반(운전자폭행등) 피고인은 2020. 4. 4. 21:41경 대구 달서구 B에서 술에 취한 채 피해자 C(남, 47세)이 운전하는 택시에 탑승하여 대구 서구 서대구로 295 북부정류장 맞은 편 도로에 도착하였고, 이에 피해자가 택시비를 달라고 하자, 발로 피해자의 오른쪽 어깨를 1회 찬 다음, 피해자에게 D 쪽으로 좀 더 가야 한다고 하여 피해자가 위 택시를 운전하여 대구 북구 E 소재 F 앞 도로를 진행하자, 갑자기 발로 피해자의 오른쪽 어깨를 1회 찼으며, 이후 피해자가 정차를 위해 위 택시를 후진 운전하면서 휴대전화로 112에 신고를 하자 주먹으로 피해자의 얼굴과 어깨를 10회 넘게 때려 피해자에게 약 2주간의 치료가 필요한 하순 열상 등의 상해를 가하였다.

Accordingly, the defendant assaulted the victim who is a taxi driver in operation and caused the injury.

2. On April 4, 2020, around 21:41, the Defendant: (a) went on a taxi driven by the victim C in Daegu-gu, Daegu-gu; (b) and (c) did not have the intent or ability to pay taxi expenses because of the lack of money; (c) but, as if he was unable to pay the taxi expenses, the Defendant would have the victim go to the North Korean illegal mooring site, the destination of which was the victim, and caused the victim to drive a taxi before the F located in Daegu-gu, Daegu-gu; (d) but (e) the Defendant did not pay 11,200 won to the victim, thereby obtaining pecuniary benefits equivalent to the above amount.
