The Defendants are 5% per annum from July 9, 2014 to December 23, 2014 with respect to each Plaintiff’s KRW 300,000,000 and its amount.
Reasons
1. Facts of recognition;
A. The relationship between the parties concerned is manufacturing and selling net containers used in the field of construction and electricity as a company with the purpose of manufacturing and selling various kinds of contact products.
Defendant C Co., Ltd (hereinafter “Defendant Co., Ltd”) manufactures and sells plastic products used in the field of construction and electricity, like the Plaintiff, as a company with the aim of manufacturing, selling, etc. of solid containers and synthetic resin.
From January 2002 to June 25, 2010, Defendant A worked as a researcher of the Plaintiff Company and took charge of the development and research of the actual container products. On May 2010, Defendant B received the proposal of the head of the Defendant Company’s inside director (general) and retired from the Plaintiff Company, and conducted research on the development of the actual container products at the E office located in the wife population D (hereinafter “D laboratory”) from the Plaintiff Company from July 2010.
B. On June 2010, Defendant A’s transfer and Plaintiff’s leakage of technical information (hereinafter “instant technical information”) data, such as product design documents, such as H-828W, H-828W1, H-727C, OE-410, which is a real container product used in the electricity and electronic field managed by the Plaintiff at the Plaintiff’s research institute located in the 426-1th floor, Nam-gu, Incheon Metropolitan City. (hereinafter “instant technical information”).
Along with the foregoing, G products were reproduced and stored on the external hard disc and were released by means of copying them to the personal computer. From July 2010 to July 2010, while developing and researching the actual container products for the Defendant company in D laboratories, F products were tested by partially replacing the materials distribution ratio and catalysts of H-828W product materials that were taken out as above in early September 201, 201; and H-727C product products that were taken out as above in November 201, 30 to partially replacing the materials distribution ratio and catalysts of raw materials; and
