The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is that the Defendant only lent money to C by deceiving C from the victim, and thus, the lower court found the Defendant guilty of the facts charged of this case even though he did not have any intention to commit fraud, and there is an error of law by misunderstanding the facts or by misunderstanding

2. The lower court rejected the Defendant’s assertion and its defense counsel’s determination in detail, on the grounds that the Defendant and the defense counsel asserted the same grounds as the grounds for appeal of this case, under the title of “the grounds for the determination of a crime and the sentencing” of the lower judgment.

According to the evidence duly adopted and investigated by the court below and the court below, the above fact-finding and judgment of the court below are just and acceptable, and the defendant is sufficiently recognized as the fact that the defendant deceivings the victim as in the facts charged in this case and the criminal intent of the defraudation.

Therefore, the defendant's assertion is without merit.

3. If so, the defendant's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
