1. The Defendant shall remove the Plaintiff’s Damo-supported signboard facilities located on the land of 10 square meters in Nam-gu Busan Metropolitan City, Nam-gu.

1. Basic facts

A. On April 21, 2016, the Plaintiff completed the registration of ownership transfer on April 28, 2016 with respect to the instant land as the current owner of the area of 10 square meters in Busan Nam-gu, Busan District Court (hereinafter “instant land”).

B. The Defendant, as the owner of the Busan Southern-gu E-based Damo (hereinafter “the instant cartel”) adjacent to the instant land, is also the owner of the Domo-supported signboard facilities installed on the instant land (hereinafter “instant facilities”).

2. Determination

A. (i) According to the above facts of determination on the part of the claim for removal of disturbance, the defendant is obligated to remove the instant structure to the plaintiff seeking removal of the instant structure as the owner of the instant land, barring special circumstances.

⑵ 피고의 주장에 관한 판단 ㈎ 피고는, 원고가 이 사건 토지의 소유권을 취득하기 이전부터 이 사건 토지는 이 사건 모텔의 진입로 부근에 위치한 약 3평 정도의 삼각형 모양의 토지여서 독자적인 사용수익이 어려운 사정 때문에 그 소유자가 독점적이고 배타적인 사용수익권을 포기함으로써 인근 주민들의 통행로로 사용되던 토지이므로, 원고의 청구는 부당하다는 취지로 다툰다.
