Basic Facts
The plaintiff shall have an indemnity mutual aid association under its jurisdiction and conduct a mutual aid project to guarantee liability for damages when a member of the mutual aid association causes property damage to a delegating person intentionally or by negligence pursuant to Article 26 (1) of the Certified Judicial Scriveners Act. The defendant is a certified judicial scrivener who is the plaintiff's mutual aid association who has delegated the affairs of application for the registration of transfer of ownership
Around February 2012, the Defendant, such as the Defendant’s unauthorized Use of Authorized Certificate, requested E to offer a loan brokerage, and E demanded the authorized certificates of the guarantor and the guarantor for credit inquiry, the Defendant, while paying the mother D as the guarantor, issued D’s authorized certificates to E.
E issued D’s above authorized certificate to F, and on March 21, 2012, F drafted a joint and several surety contract for the obligation under the performance guarantee insurance agreement to G H Co., Ltd. (hereinafter “H”) in the name of D without permission, using the above authorized certificate.
After all, as G caused a guarantee accident, H claimed reimbursement based on the above joint and several guarantee contract to D around April 2012, and the defendant, E, etc. became necessary to cope with the claim for reimbursement.
Defendant, E, etc. borrowed money from a third party as collateral for the International Apartment J (hereinafter “instant real estate”) in Gyeyang-gu, Incheon (hereinafter “D”) owned by D, taking into account the fact that the claim was already made to D for H’s indemnity, the instant real estate was already transferred under the name of the Defendant after D’s death, and borrowed money as collateral.
On May 7, 2012, the Defendant delegated the registration of ownership transfer to C, a certified judicial scrivener affiliated with the Plaintiff, with respect to the instant real estate as a branch of E on May 7, 2012, and delegated C with the registration of ownership transfer due to donation. The Plaintiff’s resident registration certificate, seal imprint certificate, certificate of personal seal impression, abstract of resident registration certificate, etc.
