A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Except as otherwise expressly provided for in any other Act, no person who violates the Electronic Financial Transactions Act shall lend a means of access to any electronic card or other means of access, such as an electronic card used for electronic financial transactions, electronic information equivalent thereto, a certificate, a password, or any other means of access;
A. On September 9, 2019, the Defendant: (a) connected to the Internet S and sent the said advertisement to the name-free box (T, one "T" and the Kakakaox hereinafter referred to as the "U") who opened the advertisement; (b) opened the account to be used for money laundering in connection with the operation of the illegal soil site; (c) sent the physical card and the OTP, and notified the account password in advance on September 12:30 on September 12, 2019; and (d) notified the name-free box of the password in the name of the Defendant using the express bus consignment service at the ideological terminal located in the Seo-gu Busan Metropolitan City, Seo-gu, Busan Metropolitan City on September 12:30, 2019.
B. On October 3, 2019, the Defendant: (a) received a proposal from the person who was absent from the name of the Defendant to pay KRW 1,00,000 per month on the face-to-face card; and (b) received the proposal and sent it to the Defendant; (c) on October 3, 2019, around 08:40, the Defendant sent three physical card numbers connected to each of the Defendant’s name accounts (Y), Z bank accounts (A), and AB bank accounts (AC) by using high-speed bus consignment services at the maritime transport terminal located in the Busan Metropolitan City Shipping Daegu Do-to-dong, Busan Metropolitan City.
C. On October 4, 2019, the Defendant continued to use a high speed bus consignment service at a shipping terminal located in the Busan Metropolitan City, Daegu Madong-dong, Busan Metropolitan City, to use a high speed bus consignment service in the name of the Defendant.
