Reasons
Punishment of the crime
The defendant is a person who is engaged in driving a D Car owned by C. D.
Around 18:10 on September 4, 2014, the Defendant driven the said car and proceeded to the direction from the front side of the F in front of the Republic of Korea E on the road located in the front side of the Republic of Korea, the Defendant got to turn to the left at the left side of the C-distance Intersection.
There are three-distance crossings in which the yellow flashing signal apparatus is installed, and the center line of yellow solid lines is installed, so in such a case, there was a duty of care to safely turn to the left within the intersection for the prevention of traffic accidents.
Nevertheless, the defendant neglected to do so and led to the left-hand turn of the vehicle at the center of the intersection without the driver's license by the negligence of the victim's G (I, 30 years old) who was driving in the opposite lane.
Ultimately, the Defendant caused injury to the victim I who was on board the Defendant’s car due to the above occupational negligence for approximately eight weeks of medical treatment, and suffered injury to the victim G in the light catitis that requires approximately two weeks of medical treatment, and at the same time, damaged the victim G to have approximately KRW 3,277,514 of the repair cost, and escaped without taking measures such as saving the victim G by stopping immediately.
