Reasons
1. Facts of recognition;
A. As to the land owned by the Plaintiff (hereinafter “instant neighboring land”), Nonparty E completed the registration of ownership transfer on the ground of sale as of November 21, 1978, and Nonparty F completed the registration of ownership transfer on the ground of sale as of February 4, 2010, and the Plaintiff completed the registration of ownership transfer on the ground of sale as of February 17, 2014.
B. As to the land owned by the Defendant, the non-party G completed the registration of ownership transfer on June 30, 1965, and the non-party G completed the registration of ownership transfer on September 7, 1990, after completing the registration of ownership transfer on the ground of sale as of September 7, 1990, the Defendant completed the registration of ownership transfer on September 11, 1996 with respect to the land of this case as to the 93.72 square meters of the above-ground bricks sloping roof, the ground of the instant land of this case.
C. An identification relationship and occupation relationship 1) Nonparty Ha is the Plaintiff’s increased support division. E is the Plaintiff’s increased support division as the wife of H, and I is the Plaintiff’s small support money as the wife of Nonparty J. 2) H acquired the ownership of the building without permission on the land adjoining to the instant case (hereinafter “instant building”) on August 1, 1935. On May 30, 2006, H acquired the ownership of the instant building on May 30, 2006.
(E) From 2006 to 2010, Nonparty I made a move-in report on the land adjacent to the instant building on June 30, 2009 and is still residing in the instant building until now. D. The instant building was built over the instant adjacent land and the instant land.
Of the instant land, part of the instant building and part of 140 square meters on the ship (A) connected with each point of the attached Table 28,29, 30, 31, 32, 33, 34, 35, 36, 37, 26, 27, 27, and 28 are currently being used for the use of the instant building, and the same appraisal is also marked 28, 4, 5, 6, 7, 45, 31, 30, 29, and 28-28.
